Privacy Policy
What data Migra BIM collects on this site, what it is used for, who it is shared with, and how to ask for it to be deleted.
Last updated: 5 October 2026 · In force from the publication of the site
This policy explains what personal data Migra BIM collects on this site, why it collects it, who it shares it with, and what you can require of us in respect of it. It follows Law 13,709/2018, Brazil’s General Data Protection Law (LGPD).
The point here is to be specific rather than generic. If anything is still unclear after reading it, write to contato@migrabim.com and we will answer.
1. Who is responsible for your data
O controller of the personal data collected on this site is:
- Registered name: Escola de Treinamento Ltda.
- Trading name: Migra BIM
- Company tax ID (CNPJ): 36.245.788/0001-43
- Registered office: Porto Alegre, Brazil
- Contact email for privacy matters: contato@migrabim.com
The controller is whoever decides what is done with the data. When we use third-party tools to run the site and send email, those companies act as processors, handling data on our behalf and following our instructions. They are listed in section 4.
2. What we collect, and when
We collect only what is needed to answer you, deliver what you asked for and understand what works on the site. We do not buy contact lists and we do not collect sensitive data (racial origin, religion, political opinion, health, biometrics and the others defined in art. 5, II of the LGPD).
| When | What we collect | If you do not provide it |
|---|---|---|
| Contact by email or phone | Name, email, phone number and the content of the message you send | We cannot answer you or put together a proposal |
| Newsletter sign-up | Email, the date and time of sign-up, the consent text you saw and the page you signed up from | You do not receive the content by email |
| Downloading free material | Name, email, date and time, consent text and which material was requested | We cannot send you the file |
| A conversation on WhatsApp | Phone number, display name and the content of the conversation | You can reach us by email instead |
| Browsing the site | IP address, browser and device type, pages visited, time spent and where you came from | The site works the same; we simply lose the measurement |
In the forms, the fields holding the date and time of consent e o exact text you read before submitting are stored alongside your email. This is not extra collection in disguise: it is the proof that consent was given and on what terms, which is exactly what the LGPD requires of anyone processing data on the basis of consent.
3. What we use it for, and on what legal basis
All processing of personal data needs a legal basis under art. 7 of the LGPD. Ours are these:
| Purpose | Legal basis |
|---|---|
| Answering an enquiry and preparing a commercial proposal | Preliminary steps relating to a contract, at the data subject’s request (art. 7, V) |
| Sending the newsletter and content about Archicad and BIM | Consent (art. 7, I) |
| Delivering free material you asked for | Consent (art. 7, I) |
| Performing and following up a contracted service | Performance of a contract (art. 7, V) |
| Measuring the site’s audience and improving the content | Legitimate interest (art. 7, IX), with aggregated data wherever possible |
| Meeting tax, accounting and legal obligations | Compliance with a legal obligation (art. 7, II) |
| Exercising rights in judicial or administrative proceedings | Regular exercise of rights (art. 7, VI) |
What we do not do. We do not sell, rent or pass on your data for third parties to use in their own campaigns. We do not make automated decisions that affect you (such as a proposal approved or refused by a system). And we do not use your email for anything other than what you signed up for.
4. Who we share it with
We share data only with the service providers the site needs to work, and only what each of them needs to do its job:
- Hostinger (site hosting): stores the site and the server access logs.
- Brevo, an email marketing platform: holds the newsletter and free-material contacts and sends the emails. Brevo’s privacy policy.
- Google Analytics and the Meta Pixel (measurement): they measure the site’s audience in aggregate and are only loaded after you accept the measurement cookies.
- WhatsApp e Instagram (Meta): when you choose to talk to us on those channels, the conversation happens under Meta’s policies.
- Accountants and legal advisers, where a contract has been signed and there is a legal duty to retain documents.
- Public authorities, only under a legal requirement or a court order.
5. Cookies and audience measurement
Cookies are small files the site stores in your browser. We use two categories:
Necessary cookies
These are the ones that make the site work: keeping your browsing preference, remembering that you have dismissed the cookie notice, and protecting the forms against automated submission. Without them the site does not run properly, which is why they do not depend on consent.
Measurement cookies
These tell us how many people visit each page, where they came from and what they read to the end. They are only switched on after you accept, in the notice that appears on your first visit. If you decline, the site carries on working normally.
You can delete or block cookies at any time in your browser settings. That applies to any site, not just this one.
6. How long we keep it
- Enquiries that did not become a contract: up to 2 years from the last contact, to keep the history of the commercial conversation.
- Newsletter and free-material sign-ups: for as long as you want to receive them. When you unsubscribe, the contact leaves the sending list and only a minimal record of the unsubscribe remains, which is what stops us emailing you again by mistake.
- Data of clients under contract: for the term of the contract and, after it, for the legal tax and accounting retention periods, currently 5 years.
- Site access logs: 6 months, under art. 15 of Brazil’s Internet Civil Framework (Law 12,965/2014).
7. Your rights, and how to use them
Art. 18 of the LGPD guarantees that you may, at any time and free of charge:
- Confirm whether we process data about you, and access that data;
- Correct incomplete, inaccurate or out-of-date data;
- Ask for anonymization, blocking or deletion of data that is unnecessary, excessive or processed unlawfully;
- Ask for portability of the data to another provider;
- Ask for deletion of data processed on the basis of your consent;
- Know who we share your data with;
- Know what happens if you do not consent, and what refusing means;
- Withdraw consent at any time;
- Object to processing carried out on the basis of legitimate interest.
To use any of them, write to contato@migrabim.com with the subject "LGPD". We answer within 15 days. We may ask you to confirm your identity first, precisely so as not to hand your data to somebody else.
To leave the newsletter you do not have to write to anyone: every email we send has an unsubscribe link in the footer, and it takes effect immediately.
If you think we have not handled your request properly, you can complain to Brazil’s National Data Protection Authority (ANPD), em gov.br/anpd.
8. Information security
We take technical and administrative measures to protect the data: an encrypted connection on the site (HTTPS), tool access limited to the team members who need it, two-factor authentication on administrative accounts, and choosing suppliers that have a security policy of their own.
No system is infallible, and it would be dishonest to promise otherwise. If a security incident occurs that could bring you significant risk or harm, we will notify you and the ANPD, under art. 48 of the LGPD.
9. Children and young people
This site is aimed at professionals and companies in architecture and construction and is not intended for anyone under 18. We do not knowingly collect data from children or young people. If we find a sign-up in that situation, it is deleted.
10. International data transfers
Some of the tools we use are run by companies outside Brazil and may store data on servers in other countries. That is the case with Brevo, based in France and itself subject to the European General Data Protection Regulation (GDPR), and with services from Google and Meta.
Those transfers take place within the cases set out in art. 33 of the LGPD, with suppliers offering a level of protection compatible with Brazilian law.
11. If you are in the European Union or the United Kingdom
Migra BIM is established in Brazil and this policy is written to meet the LGPD. Where the European GDPR or the UK GDPR applies to you, the rights it gives you are equivalent to the ones in section 7, and you exercise them the same way, by writing to contato@migrabim.com: access, rectification, erasure, restriction of processing, data portability, objection, and withdrawal of consent at any time.
The legal grounds we rely on map onto the GDPR as follows: answering your enquiry and preparing a proposal, steps taken at your request prior to a contract; the newsletter and free material, your consent; delivering a contracted service, performance of a contract; audience measurement, our legitimate interest; tax and accounting records, a legal obligation.
Your data may be transferred to Brazil and to the countries where our suppliers operate. Brevo is based in France and is itself subject to the GDPR. If you believe we have not handled your request properly, you can complain to the supervisory authority in your country.
12. Changes to this policy
This policy may be updated when we change a practice, a tool or a legal requirement. The date it was last updated is always at the top of this page. If a change matters to people already on our list, we tell them by email before it takes effect.
13. Object Optimizer (the app)
O Migra BIM Object Optimizer is an app installed on your computer. It talks to this site at three moments, and only those:
- At license registration, the first time it opens: the name that goes on the license, the email used for the purchase, the tax ID, the computer name, the app version and an installation identifier.
- During use, periodically: a code derived from the license key (not the key itself), the computer name and the time of the last contact, to control the simultaneous use the license allows.
- When the license moves to another computer: the date, the licensee’s name, the email and the names of the computers involved.
Your files never leave your computer. The .skp models and the .gsm objects produced are not sent to the site or to Migra BIM: the whole conversion happens locally.
What we use it for: issuing and validating the license, controlling use under the terms of use and providing support. The legal basis is performance of the license agreement (art. 7, V of the LGPD) and, for controlling simultaneous use, the legitimate interest in protecting the product (art. 7, IX).
How long for: the registration data is kept for as long as the license exists and, after that, for the legal tax retention periods. The usage signals are overwritten at each contact and computer changes are logged for up to 2 years. All of it sits in files on this site’s server, with no access over the internet, and is handled only by the Migra BIM team.
